The court emphasizes that candidates cleared the necessary tests must be fairly included in recruitment lists as per prior court directives.

ORDER

The above writ petition has been filed by the petitioners seeking a direction to the respondents to include the petitioners in the appointment lists, viz., List Nos.1 and 2 of the final merit list, and to issue appointment orders to the petitioners in a time bound manner.

2.The grievance of the petitioners is that despite they having successfully cleared the Computer based examinations for the the posts of Constable (General Duty) in the Central Armed Police Forces (CAPFs) and SSF, Rifleman (GD) in Assam Rifles, and Sepoy, they have been wrongfully declared as disqualified in the Physical Standard Test (PST) and Physical Efficiency Test (PET) on the ground of alleged marginal deficiency in height. Aggrieved by the same, they approached this Court and vide orders of this Court dated 28.10.2025 in W.P.Nos.33420 of 2025 etc., batch, this Court quashed the PST rejection slips and directed the respondents to conduct fresh PST/PET.

3. The orders of this Court had been complied with and re-test was conducted on 28.11.2025 and the petitioners had qualified in PST / PET and they have completed all stages of selection process. The final merit list was published by the respondents only on 15.01.2026 and the names of the petitioners were placed in the "Withheld List" (List No.3). The petitioners would submit that the names of the similarly placed candidates were placed in Appointment Lists 1 and 2. Therefore, the petitioners would contend that their names being included in the Withheld List is only a vindictive action taken against them, as they have approached this Court in the earlier batch of writ petitions seeking to quash the PST/PET slips. Hence, the petitioners are before this Court.

4. Heard the learned counsel on either side and also perused the materials placed before this Court.

5.Mr.A.R.Sakthivel, learned Central Government Standing Counsel appearing for respondents 1 to6, has produced before the Court a Note received from the DIG (Recruitment), dated 06.03.2026, wherein it has been stated as follows :

" .... .... ..... In this connection , it is intimated that in compliance of common court order dated 28/10/2025, PET/PST of 185 eligible petitioners were conducted on 22/12/2025 at GC AVD(.) After completion of PET/PST, case for revision of result of PET/PST was sent to SSC on 26/12.2025 and the same was revised by SSC on 07/01/2026 wherein total 83 petitioners were declared qualified(.) Accordingly directions were issued to GC AVD to conduct further recruitment tests viz DV/DME and RME (if applicable) on 19/01/2026 in respect of qualified 83 candidates (petitioners) vide this Dte signal of even No. dated 09/01/2026 (.) Meanwhile SSC has published final result of Constable (G) Exam-2025 on 15/01/2026(.) But this will not impact the recruitment/selection process of these petitioners if they qualify all recruitment tests(.) As per directions, DV/DME and RME (if applicable) of above 83 petitioners were conducted at GC AVD wef 19/01/2026 to 23/01/2026 wherein 63 petitioners have been declared FIT and accordingly case of revision of result of all 8 petitioners (63 Fit, 20 Unfit) has already been sent to SSC on 30/01/2026 (copy enclosed) (.) After revision of result from SSC, suitable directions will be issued immediately to the all concerned for issuance of Offer of Appointment to the eligible petitioners(.)

6. Recording the above, the writ petition is disposed of. No costs.
