A Writ Petition becomes infructuous if the relief sought is rendered moot by events occurring prior to the hearing.

Headnote:The present writ petition was filed under Article 226 of the Constitution of India seeking a Writ of Mandamus to forbear the respondents from granting an FL2 license for establishing a recreation club in a residential area. However, the Court noted that the application by the seventh respondent was rejected prior to the hearing, rendering the case infructuous. The court decided to dismiss the petition accordingly.

The present writ petition has been filed for the following relief:

“To forbear the respondents 1 to 6 from granting the FL2 license to the seventh respondent to open a recreation club in the residential area in the Anaikkaraipatti Village by considering the petitioner’s representations dated 19.01.2026 and 03.02.2026.”

2. The learned Additional Government Pleader for the respondents

1, 2 and 5 submits that the application filed by the seventh respondent has already been rejected on 12.02.2026 by the Commissioner of Prohibition and Excise, Chennai. Hence, nothing survives for further adjudication.

3. In view of the above, this Writ Petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
