Versus
The Inspector General Of Registration – Respondent

Advocates:
For the Appellants/Petitioners: Mr.L.Chandrakumar
For the Respondents: Mr.U.Baranidharan,SGP

Petitioner's right to register a sale deed upheld given compliance with Section 34-C of the Registration Act regarding the non-traceability certificate.

Headnote:This judgment discusses the provisions of Section 34-C of the Registration Act, allowing for registration of documents without original parent documents if supported by a non-traceability certificate. The court found the refusal to register the sale deed based on lack of documentation to be erroneous when the petitioner agreed to produce the required certificate. The court directed the respondents to register the sale deed upon submission of the non-traceability certificate and granted the petitioner liberty to apply for it to the appropriate police.

Order

This writ petition has been filed, challenging the impugned refusal check slip dated 31.01.2026, refusing to register the sale deed, presented by the petitioner for registration on the ground that the original parent document has not been produced by the petitioner.

2.On the last hearing date i.e. 04.03.2026, the learned Additional Government Pleader, who accepted notice on behalf of the respondents, pointed out that in view of the newly amended Section 34-C of the Registration Act, the second respondent has rightly refused to register the sale deed, presented by the petitioner for registration since the petitioner has not produced the non-

traceability certificate in lieu of the original parent document.

3.Learned counsel for the petitioner would now submit on instructions that the petitioner is willing to produce the Non-Traceability Certificate to the respondents, to enable the petitioner to register the sale deed, which is the subject matter of this writ petition for registration.

4.Section 34-C of the Registration Act enables the registration department to register a document for registration in case the original parent document is lost by substituting the same with a non-traceability certificate.

5.Since the petitioner has agreed to provide the non-traceability certificate to the respondents, this writ petition is disposed of by directing the respondents to register the sale deed, presented by the petitioner for registration as and when the petitioner produces the non-traceability certificate for the parent document from the appropriate jurisdictional police.

6.A request is made by the learned counsel for the petitioner, on instructions that the petitioner may be given liberty to make an appropriate application with the jurisdictional police seeking for issuance of non-traceability certificate.

7.No prejudice would be caused if such a liberty is granted to the petitioner.

8.Accordingly, this Court grants liberty for the petitioner to seek for non-

traceability certificate in respect of the parent document with the appropriate jurisdictional police and the said jurisdictional police station shall consider the same, on merits and in accordance with law. No costs.
