2026 Supreme(Online)(Mad) 23912

IN THE HIGH COURT OF JUDICATURE AT MADRAS
G.R.Swaminathan, B.Pugalendhi, JJ
Palanisamy – Appellant
Versus
The District Collector, Tiruchirappalli District – Respondent
W.P.(MD)No.6440 of 2026

Advocates:
For the Appellants/Petitioners: Mr.T.M.Madasamy
For the Respondents: Mr.G.V.Vairam Santhosh, Additional Government Pleader for R-1 to R-4

The court upheld the classification of land as patta land, dismissing the writ petition due to lack of evidence.

Headnote:Relevant to the case is Article 226 of the Constitution of India regarding writ petitions for mandamus. The petitioner claimed that the encroachment made by the fifth respondent should be rectified and demanded the cancellation of a patta issued to the fifth respondent. The court found insufficient evidence to support the petitioner's claims and confirmed the classification of the land as patta land. The primary issues revolved around the legitimacy of the patta issuance, with the court noting that the petitioner failed to demonstrate that it was categorically patta land. Consequently, the writ petition was dismissed without costs.

O R D E R

Heard the learned counsel appearing for the writ petitioner and the learned Additional Government Pleader appearing for respondents 1 to 4.

2. Even according to the petitioner, survey No.118/2 of Usilampatty Village has been classified as patta land; he would, however, claim that it was originally a water-body and that patta was issued only recently.

3. We wanted to know when the patta was issued. The petitioner is unable to place any material in respect of his claim that patta was issued only in the year 2015. On the other hand, the learned Additional Government Pleader produced “A” Register extract from which it can be seen that even during UDR, survey No.118/2 has been classified as patta land. We are not inclined to grant any relief. This writ petition stands dismissed. No costs.
