O R D E R
This writ petition has been filed seeking a writ of mandamus directing the first respondent to number the revision petition filed by the petitioner dated 29.09.2025 and to dispose of the same on merits within a stipulated time frame and consequently to direct the third respondent to withhold one vacancy in the post of Manager in the promotion list dated
01.12.2025 pending disposal of the said revision petition.
2. From the perusal of the affidavit and as seen from the arguments advanced by the learned counsel for the petitioner, it appears that the present writ petition has been filed complaining that the revision petition that was filed by the petitioner on 29.09.2025 has not been taken on file and numbered by the first respondent. Under those circumstances, on the earlier occasion, when the matter came up for consideration for admission, this Court vide order dated 18.03.2026 directed the learned Special Government Pleader appearing for the respondents 1 & 2 to get instructions in this matter.
3. Today, when the matter is taken up for consideration again, it is brought to the notice of this Court by the learned Special Government Pleader appearing for the respondents 1 & 2 that the revision petition filed by the petitioner has already been taken on file vide RC No.4154/2025 SF on 20.11.2025 and a counter-statement is also stated to have been filed by the third respondent herein as early as on 12.02.2026 and the matter is pending for filing rejoinder, if any, by the petitioner herein.
4. In the light of the above, this Court is not inclined to accept the case of the petitioner as contended before this Court. However, taking into consideration the fact that the revision petition filed by the petitioner under Section 153 of the Tamil Nadu Co-Operative Societies Act, 1983, has already been taken on file and the same is pending for filing rejoinder, if any, by the petitioner, this writ petition is disposed of granting liberty to the petitioner to file rejoinder within a period of one week from today and with a further direction to the first respondent to dispose of the revision petition filed by the petitioner within a period of three weeks from today and communicate the order of the revision petition to the petitioner. No costs. Consequently, connected miscellaneous petition is closed.
