The Court emphasized the necessity of adhering to its directives regarding the organization of meetings and established that postponing such meetings can amount to contempt of court.

COMMON ORDER

This Court already directed to conduct the general body meeting with the assistance of the Advocate Commissioner in terms of the bylaws. However, it is submitted that after passing such an order, the Secretary has issued a notice that based on the interim order, the general body meeting is postponed. This Court felt that the said communication amounts to contempt. Hence, suo motu contempt was initiated and the contemnor was present before this Court on 16.03.2026. The contemnor submitted before this Court that he is ready and willing to convene the general body meeting and there is no objection from his side. The said statement was recorded.

2.The Advocate Commissioner shall convene the general body meeting on 18.04.2026 and complete the general body meeting as directed in the earlier order. The fees for the Advocate Commissioner shall be paid by the society (50%) and the petitioner (50%) ie., equally. If there is any difficulty, the parties are at liberty to approach this Court. If the Advocate Commissioner is seeking police protection, the same may be provided by the jurisdictional police station.

3.With the above observations, this Writ Petition and the contempt petition are closed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
