Court dismisses appeal as withdrawn following parties' settlement and orders court fee refund.

Headnote:The appeal was filed under Section 96 of the CPC to overturn the judgment dated 23-10-2025 in OS No. 66 of 2023. The appellants expressed intention to settle the matter and requested withdrawal of the appeal. The Court dismissed the appeal as withdrawn and granted a refund of court fees.

The appellants have filed an affidavit, which is as follows:

1.I am the 1st Appellant in the appeal and as such I am well acquainted with the facts of the case. I also swear this affidavit for myself and also on behalf of the 2nd Appellant.

2.I submit that I have preferred the above said A.S.No.348 of 2026 against O.S.No.66 of 2023 on the file of the District Judge, Mayiladuthurai as against the respondents.

3.I submit that I am interested in paying the amount in full as decreed in the O.S.No.66 of 2023 of Mayiladuthurai District Court and arranging funds to the respondents. Therefore I request for withdrawal of the appeal A.S.348 of 2026 filed in the Madras High Court Chennai in the O.S.No.66 of 2023 of Mayiladuthurai Court.

4.I further submit that I pray that this Hon'ble Court may be pleased to refund the court fees of Rs.2,41,379/- (Rupees Two Lakhs Forty One Thousand Three Hundred and Seventy Nine Only) paid in A.S.No.348 of 2026 in our favour. It is therefore prayed that this Hon'ble Court may be pleased to permit to withdraw A.S.No.348 of 2026 and pass necessary order and thus render justice.

2.The learned counsel for the appellants has also made the following endorsement in the case bundle:

The appellants may be permitted to withdraw the appeal since the matter is going to settled among the parties.

3.In view of the fact that the matter has been settled out of Court, the appeal stands dismissed as withdrawn. The appellants are entitled for refund of Court fees in accordance with law. No costs. Consequently, connected miscellaneous petition is also closed.
