ORDER
The learned counsel for the revision petitioner has filed this Civil Revision Petition seeking to set aside the docket order dated 17.02.2026 made in O.S. CFR No.3560 of 2026 on the file of the District Munsif Court, Nilgiris, Udhagamandalam.
2. The learned counsel for the revision petitioner submitted that the petitioner had filed a suit for the relief of declaration under Section 25(d) of the Tamil Nadu Court Fees and Suits Valuation Act, in respect of certain sale deeds, seeking rectification of survey numbers as against the defendants. However, the learned trial Judge was not inclined to take the case on file and returned the plaint on various grounds. Thereafter, all the defects pointed out were duly complied with, but even then, the plaint was not taken on file. He further submitted that the plaintiff had also clarified all the issues raised. Aggrieved by the same, the present Civil Revision Petition has been filed.
3. On consideration, it is seen that the plaintiff has approached the Court by paying the requisite court fee and has properly described the relief sought in the plaint along with necessary pleadings. This Court is satisfied that the same is sufficient to take the case on file and that, prima facie, the defects pointed out have been duly complied with. Therefore, the learned trial Judge is directed to take the case on file within a period of one week from the date of receipt of a copy of this order.
4. The Registry is directed to return the original plaint immediately. In view of the above, this Civil Revision Petition is disposed of. No Costs.
