2017 dated 09.08.2018 by the learned III Additional District Sessions Judge, Cuddalore at Vridhachalam, confirming the judgment passed by the learned Judicial Magistate I, Vridhachalam in STC.Nos.1306 of 2014 dated 03.10.2017.

Rajasekaran ... Respondent This case came up for settlement before the National Lok Adalat. Both the parties are present. M/s.R.Balachandran and Tamizhselvan, the learned counsel for the Revision Petitioner and Mr.R.Sethuvarayar, learned counsel for the respondent are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT Both the parties and their respective counsel are present.

2. The parties have settled the matter amicably. Their identities are verified based on their Aadhar Cards.

3. The learned counsel for the revision petitioner would submit that as directed by this Court they have deposited a sum of Rs.3,60,000/- before the Registrar General, High Court of Madras, Chennai and he has no objection for the same to be withdrawn by the complainant / respondent herein. Based on the above settlement arrived at between the parties today, the revision petitioner / accused has handed over a sum of Rs.2,80,000/- (Rupees Two Lakhs Eighty Thousand only) towards cash to the complainant / respondent, who is a senior citizen, aged about 87 years accompanied with his son viz. Mr.R.Ravichandran, Aadhar Card No.584031863647.

As the parties have mutually agreed for the above settlement in full quit, the same is recorded and the Registrar General, High Court of Madras is directed to disburse the deposited amount of Rs.3,60,000/- with accrued interest if any, to the complainant / respondent after due verification, within a period of four (4) weeks from the date of receipt of a copy of this order.

5.The sureites furnished by the revision petitioner herein before the trial Court shall be resolved by the Lok Adalat Settlement. The cash deposit made by the petitioner, if any, before the trial Court shall be remitted back to the accused / revision petitioner after due verification by the trial Court.

6..In view of the above settlment arrived at between the parties, the conviction imposed by the tiral Court in STC.No.1306 of 2014 is set aside in terms of Section 320 Cr.P.C. This Criminal Revision Petition stands closed accordingly.
