Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue a writ of certiorari to call for the records relating to the impugned notice dated 05.05.2025 issued by the 2nd respondent under Section 6 of the Tamilnadu Land Encroachment Act, in respect of the land comprised in Survey No.309/4B, situate at Vaalikandapuram Village, Veppanthattai taluk, Perambalur District and to quash the same.

Heard both sides.

2. The petitioner challenges the impugned order passed under Section 6 of the Tamil Nadu Land Encroachment Act, 1905. It is not in dispute that an appeal would lie against such an order. The petitioner is granted liberty to file an appeal. If such an appeal is filed within a period of three weeks from the date of receipt of a copy of this order, the same will be entertained by the appellate authority without reference to limitation. If the petitioner files an appeal within the time limit as aforesaid, the impugned order will be kept in abeyance till the disposal of the appeal.

3. The writ petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
