O R D E R
This Writ Petition has been filed to direct the 1st respondent to refer the representation of the petitioner dated 10.02.2025, seeking for enhancement of compensation to the Arbitrator to be appointed by the Central Government.
2.The petitioner, aggrieved by the lower fixation of the compensation amount for the acquired lands of the petitioner, had earlier given a representation to the 1st respondent on 10.02.2025, to refer the request for enhancement of claim to the Arbitrator as per provisions of Section 3-G (5) of the National Highways Act, 1956. Since the same has not been considered till date, the petitioner has filed this Writ Petition.
3.Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the respondents.
4.No prejudice would be caused to the respondents if a direction is issued by this Court to pass final orders on merits an in accordance with law on the petitioner’s representation as stated supra, within a time frame to be fixed by this Court.
5.For the foregoing reasons, this Court directs the 1st respondent to pass final orders on merits and in accordance with law, on the petitioner’s representation dated 10.02.2025, seeking for reference to the Arbitrator as per provisions of Section 3-G (5) of the National Highways Act, 1956, within a period of six weeks from the date of receipt of a copy of this order.
6.With the above direction, this Writ Petition is disposed of. However, there shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
