Writ petition is filed under Article 226 of the Constitution of India seeking for issuance of a writ of certiorarified mandamus to call for the records of the respondent culminating in the refusal slip RFL/Sathyamangalam/4/2026 dated 11.02.2026 issued by the respondent herein, quash the same and consequently direct the Sub Registrar, sathyamangalam, the respondent herein to register the settlement deed dated 11.02.2026 executed by the petitioner settling the property comprised in Ka.Sa.544 Ne.Pu.He 1.22.0 (old Ka, Sa.98 Pu.A.3.01, situated in sathyamangalam taluk, thingalur B village, gopichettypalayam district, situated within the registration Sub-District of sathyamangalam, to and in favour of of his son R.Suresh Kumar in consideration of natural love and affection without insisting upon production of original of the parent document No.2657/2015, SRO, Satyamangalam, within a time limit that may be prescribed by this Court. ORDER

This writ petition has been filed challenging the impugned refusal check slip issued by the respondent dated 11.02.2026 refusing to register the settlement deed dated 11.02.2026 presented by the petitioner for registration, on the ground that the petitioner has not produced the original parent document.

2. As per Section 34-C of the Registration Act, there is a necessity to produce the original document or non-traceable certificate.

3. The learned counsel for the petitioner on instructions submits that the petitioner will take all efforts to obtain a non-traceable certificate to enable the petitioner to get the settlement deed dated 11.02.2026 registered by the registration department.

4. Since the petitioner is willing to produce the non-traceable certificate in respect of the parent document, the impugned refusal check slip dated 11.02.2026 issued by the respondent is hereby quashed, and the petitioner is directed to produce the non-traceable certificate to the respondent. On production of the same, the respondent shall register the settlement deed dated 11.02.2026, if it is otherwise in order, subject to payment of requisite stamp duty and registration fee. With the above directions, this writ petition is disposed of. No Costs.
