The Tahsildar O/o.Tahsildar Krishnagiri Taluk Krishnagiri District – Respondent
WMP NO. 11035 OF 2026

Advocates:
For the Petitioner(s): Mr.S.Esakkimuthu
For the Respondent(s):Mr.S.Arumugam Govt.Advocate

Non-speaking orders rejecting patta violate natural justice; must be quashed and remanded for reasoned hearing.

Headnote:The petitioner challenged an administrative order rejecting his application for issuance of patta for a specified property. The impugned order lacked reasons and violated principles of natural justice by denying a hearing. The court found the order to be non-speaking and procedurally flawed. Issues framed centered on the absence of reasoned decision and opportunity to be heard. The ratio decidendi emphasized that rejection of patta applications must be speaking orders compliant with natural justice, requiring fresh consideration after hearing. The writ petition was allowed, impugned order quashed, and matter remanded for fresh disposal within specified timelines.

14.12.2024 issued by the respondent, rejecting the petitioner’s application seeking for issuance of patta in his name for the property morefully described in the prayer to this writ petition.

2. As seen from the impugned order dated 14.12.2024, the respondent has not given any reason for rejecting the petitioner’s application, seeking for issuance of patta in his name. The petitioner was also not afforded any opportunity of hearing by the respondent prior to passing of the impugned order dated 14.12.2024.

4. Accordingly, the impugned order dated 14.12.2024 issued by the respondent is hereby quashed and the matter is remanded back to the respondent for fresh consideration on merits and in accordance with law.
