2026 Supreme(Online)(Mad) 26142

IN THE HIGH COURT OF JUDICATURE AT MADRAS
K.KUMARESH BABU, J
K.E.Madheswaran – Appellant
Versus
Shanmugam – Respondent
C.M.P.No.3759 of 2020

Advocates:
For the Appellants/Petitioners: Mr.S.Chendur Eashwaran, for Mr.E.C.Ramesh

Revision petition rendered infructuous upon disposal of main suit.

Headnote:The petitioner filed a Civil Revision Petition under Article 227 of the Constitution of India challenging an order passed by the 1st Additional District Munsif, Erode in I.A.No.1 of 2019 in O.S.No.346 of 2014 dated 18.07.2019. The main suit O.S.No.346 of 2014 was disposed of on 27.07.2023. The court found that the revision petition has become infructuous due to the disposal of the main suit. The sole issue was whether the revision petition survives after disposal of the underlying suit. The court observed that the submission by counsel rendered the petition infructuous, applying the principle that challenges to interim orders in suits that conclude become moot. The Civil Revision Petition is dismissed with no order as to costs; connected miscellaneous petition closed.
