Mandamus directs enquiry outcome on objection to electricity infrastructure on private land.

PRAYER Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the 1st respondent herein to conduct enquiry based on the objection petitioner dated 23.06.2021 submitted by the petitioner under Sec. 12(2) of the Electricity Act 1910 Read with Rule 3 (1) (a) and (b) of Works of Licensees Rules 2006 and section 16 (1) of Telegraphs Act 1885 and consequently direct the respondents 2-5 to drop the proposal of planting the electric poles and drawing service ines in the petitioner land in S. ORDER

This writ petition has been filed to direct the 1^st respondent herein to conduct enquiry based on the petitioner’s objection dated 23.06.2021.

2. The learned counsel for the petitioner as well as the respondent would submit that the enquiry was conducted based on the petitioner's representation. However, both are not in a position to ascertain as to whether the orders were passed or not.

3. In view of the above, this Court passes the following order: i) If no order is passed after enquiry, this Court directs the respondents to pass order, on merits and in accordance with law, within a period of 8 weeks from the date of receipt of a copy of this order;

ii) If the order was already passed, this Court directs the respondents to issue a copy of the order to the petitioner within a period of 2 weeks from the date of receipt of a copy of this order.

iii) The petitioner is granted liberty to challenge the order, either passed or to be passed, by the respondents.

4. With the above directions, this writ petition is disposed of. No cost.
