Versus
The State of Tamilnadu – Respondent
WP. Crl.No.684 of 2026
For Petitioner(s): Mr.M.Manoharan
For Respondent(s): Mr. R. Muniyapparaj, Additional Public Prosecutor, Assisted By Mr. M. Sylvester John
Prison authorities must consider emergency leave representations upon submission of required medical evidence within stipulated time.
Headnote:The petition under Article 226 seeks a writ of mandamus directing consideration of a representation for grant of 30 days emergency leave without escort to the petitioner's son, a convict prisoner. The court notes the authorities require medical records and supporting particulars. The court directs production of evidence within three days and consideration of the representation within two weeks thereafter. The sole issue is whether the prison authorities must expeditiously consider the representation for emergency leave. The ratio decidendi emphasizes procedural fairness in requiring supporting documents before granting leave, ensuring timely disposal upon submission. Writ Petition disposed with directions to produce particulars and pass orders on representation.
