The Writ Petition has been instituted challenging the notice issued under Section 6 of the Tamil Nadu Land Encroachment Act, 1905 [hereinafter referred to as “the Act”].

2. The learned counsel for the petitioner would submit that the subject land is a Government Poramboke land and therefore the Act will not apply.

3. The learned Additional Government Pleader would oppose by stating that under Revenue Standing Orders RSO-21 the Revenue Authorities are empowered to invoke the provisions of the Act for eviction of encroachers in respect of Government Natham land, which remain unassigned by the Government.

4. If at all the petitioner is aggrieved, he is at liberty to prefer an appeal under Section 10 of the Act before the District Collector.
