IN THE HIGH COURT OF JUDICATURE AT MADRAS
G.R.SWAMINATHAN, R.POORNIMA, JJ
Palanichamy – Appellant
Versus
The Block Development Officer, Thoppampatti Panchayat Union, Palani Taluk, Dindigul District – Respondent
W.P.(MD)No.14156 of 2019 | W.M.P.(MD)Nos.10629 & 10630 of 2019
For the Appellants/Petitioners: Mr.D.Venkatesh
For the Respondents:Mr.S.Vinodh, Government Advocate
Writ petition rendered infructuous due to removal of encroachment pursuant to prior court order.
Headnote:The petitioner sought a writ of certiorari under Article 226 of the Constitution of India to quash the respondent's order dated 14.06.2019 pertaining to proceedings Na.Ka.No.257/2017/B3. The court noted the impugned order's potential invalidity but was informed that the encroachment had been removed pursuant to a Division Bench order in W.P.(MD)No.6995 of 2019 dated 30.06.2025. The court determined the petition had become infructuous. The sole issue was whether the writ petition required adjudication given the removal of the encroachment. The court's reasoning hinged on the subsequent Division Bench order rendering the relief moot. The writ petition is closed with no costs.
