Mandamus directs inquiry into temple land mutation and fit person appointment under HRCE Act.

Headnote:The petition invokes Article 226 seeking mandamus under Sections 49, 78, and 79 of the Hindu Religious and Charitable Endowments Act, 1959, for appointment of a fit person or direct management of the temple and restoration of specified temple lands wrongfully mutated. Essential facts include representation dated 15.10.2025 regarding land in S.No.216/3A mutated to temple caretaker. Court finds temple unlisted but public, directing inquiry without merits opinion. Issue framed as directing authorities to address representation for temple administration and land records. Ratio emphasizes enquiry by Assistant Commissioner with notice to interested parties, recognition of property as temple land, and steps for re-mutation and fit person appointment post-hearing. For Petitioner : Mr.M.S.Sheik Abdullah For R1 and R2 : Mr.M.Sarangan Additional Government Pleader ORDER The writ petition is filed for a mandamus directing the respondents to appoint a 'Fit Person' with reference to Arulmigu Arumugaswamy Temple, Vadakkunatham, Aruppukottai Taluk, Virudhunagar District.

2. The case of the petitioner is that the land in S.No.216/3A also belongs to the said temple. The Assistant Commissioner, Virudhunagar District will enquire into the matter and pass appropriate orders.

4. This writ petition is disposed of at the admission stage itself without expressing any opinion on the merits of the matter and also taking into account that the persons in charge of the temple are not parties to this writ petition.

5. In view of the limited relief sought for in the writ petition, the writ petition is disposed of on the following terms:-

i. The Assistant Commissioner, Virudhunagar District, shall take up the petitioner’s representation dated 15.10.2025 for enquiry. Due notice shall be issued to the petitioner as well as to all persons interested in the temple and to any person in whose name the patta has been changed. After conducting the enquiry and hearing both sides, appropriate orders shall be passed.

ii. It is needless to mention that the property is temple property. After hearing the parties, appropriate steps shall be taken with the authorities to re-mutate the records in favor of the temple and to place the temple under proper administration by appointing a fit person.

iii.No costs.
