Dhatchianamoorthy, No.45, Suaiman Garden, Thirukokarnam, Pudukottai District. ...Respondent/s This case came up for settlement before the Lok Adalat. Both the parties present. The appellant Vani and Dr.R.Alagumani, learned counsel for the appellant and the respondent Sukumar are present. After mutual discussion, negotiation, mediation and conciliation between both parties and with the assistance of the Bench, both sides consented for settlement.

AWARD The wife is the appellant and the husband is the respondent. The appeal is at the instance of the wife, challenging the dismissal of H.M.O.P.No.818 of 2014, on the file of the Family Court, Thiruchirappali, dismissing the divorce petition filed by the wife appellant.

Today, both the appellant wife and the respondent husband are present.

After long discussion and deliberations, taking into account the daughter who was minor at the time of filing of H.M.O.P., has now attained majority and is aged about 22 years and pursuing her final year Engineering degree, and after 2012, even according to the appellant, the husband has not maintained his wife and his daughter, the parties have now amicably decided to part away by mutual consent before the Family Court, Tiruchirappalli. The appellant wife has undertook that she would not claim any amount towards maintenance, either past, present, or in future and she also states that the daughter is also not interested in receiving any money from her father, considering the fact that she has not even seen her father for several years together.

In the light of the above settlement reached between the parties, this Civil Miscellaneous Appeal is disposed of, giving liberty to the appellant and the respondent to file a petition for divorce under Section 13-B of the Hindu Marriage Act, before the jurisdictional Family Court, Tiruchirappalli.

The parties have infact agreed to go over to the Family Court, Tiruchirappalli on 25.03.2026 and present the petition for divorce for mutual consent. The parties shall co-operate for disposing the divorce petition, by ensuring all compliance with numbering the O.P., and the Court shall fix the date for their appearance for recording statements.

This Lok Adalat award is passed in terms of the above settlement.

The full Court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamilnadu Court Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.

The Original of the award shall be place in the court record and copy of the award, kept with High Court Legal Services Committee and one copy each is furnished to both parties free of cost.

In agreement of the above, both parties and their counsel have affixed their signatures/ thumb impressions in presence of the Lok Adalat Bench admitting the terms and today conditions and accordingly, the award is passed.
