The present petition has been filed by the sole accused in Spl.S.C.No.172 of 2024 on the file of the Special Court for Exclusive Trial of Cases under POCSO Act, Dindigul, seeking to quash the charge sheet in Spl.S.C.No.172 of 2024, wherein, the petitioner is alleged to have committed the offences under Section 9 of Prohibition of Child Marriage Act, 2006 and Sections 5(I), 5(j)(ii), 6 and 5(n) of POCSO Act, 2012.

2.The petitioner is said to have sexually assaulted the victim girl on 12.02.2024. The date of birth of the victim girl is 19.10.2007 and she had attained majority on 19.10.2025. The victim girl had married the accused person on 16.11.2025 after attaining the age of majority and it has been registered on 20.11.2025.

3.The victim girl is present in person before this Court today and she submits that the charge sheet as against her husband/petitioner herein may be quashed, since they are leading a happy life.

4. Considering the aforesaid circumstances, the charge sheet in Spl.S.C.No.172 of 2024 on the file of the Special Court for Exclusive Trial of Cases under POCSO Act, Dindigul, is hereby quashed. The Criminal Original Petition stands allowed.
