The present Writ Petition has been instituted challenging the final notice under Section 6 of the Tamil Nadu Land Encroachment Act, 1905 [hereinafter referred to as “the Act”].
2. Against the final notice an appeal would lie under Section 10 of the Act before the District Collector.
3. The learned counsel for the petitioner would submit that the petitioner has mistakenly preferred an appeal before the Commissioner of Land Administration.
4. Granting liberty to the petitioner to file an appeal before the District Collector under Section 10 of the Act, the present Writ Petition stands dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
