ORDER

This Writ Petition has been filed seeking a direction to the respondents to forthwith terminate the Energy Purchase Agreements dated 21.03.2003, 28.09.2003 and 24.03.2005 relating to the petitioner’s Wind Energy Generators bearing HTSC Nos. 543, 617 and 1170 respectively on the basis of the petitioner’s representation dated 16.10.2025 and consequently, to effect change in utility to the petitioner’s Wind Energy Generators to third party sale through open access in accordance with the petitioner’s right to open access under the Electricity Act, 2003.

2. Heard the learned counsel appearing on either side. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself.

It is the case of the petitioner that the petitioner is a textile factory in Kancheepuram and Chengalpattu Districts and also engaged in generation of electricity through Wind Energy Generators and is owning three Wind Energy Generators [WEGs]. The petitioner entered into the Energy Purchase Agreements with the first respondent in respect of its WEGs and has exercised its contractual right of termination in accordance with the terms of the said agreements. Despite the petitioner’s representation dated 16.10.2025, the respondents have not acted upon it and hence, the present petition. The petitioner has also sought to effect change in utility of the petitioner’s WEGs to third party sale through open access as per the Electricity Act, due to critical need of severe cost impact due to import tariffs on textile and apparel exports.

In view of the limited prayer sought for by the petitioner in this Writ Petition, there shall be a direction to the respondents to consider the representation of the petitioner dated 16.10.2025 and to pass appropriate orders in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

5. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
