Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the 1st and 2rd respondent to correct the date of birth of the petitioner as per the date mentioned in his birth certificate i.e. 20.08.1997 instead of 20.07.1997 in all three X standard marks

1.Certificate No.2549628 dated 31.05.2013, 2.Certificate Sl.No.12029141 dated 19.11.2021 and 3.Certificate No.22949304 dated 26.06.2022 and issue a fresh mark statements mentioning correct date of birth ad further direct the 4th respondent to correct the date of birth in the X Standard Transfer Certificate and issue a fresh Transfer certificate within the time frame fixed by this Honourable Court For Petitioner(s): Mr.P.Arumugavel For Respondent(s): Ms.Mythreye Chandru, SGP

ORDER

This Writ Petition has been filed seeking a direction to the respondents 1 & 2 to correct the date of birth of the petitioner as per the date mentioned in his Birth Certificate i.e., 20.08.1997 instead of 20.07.1997 in all the three X Standard Mark Sheets namely, 1.Certificate No.2549628 dated 31.05.2013, 2.Certificate Sl.No.12029141 dated 19.11.2021 & 3.Certificate No.22949304 dated 26.06.2022 and issue a fresh mark statements mentioning the correct date of birth and further to direct the fourth respondent to correct the date of birth in the X Standard Transfer Certificate and issue a fresh Transfer certificate, within the time frame as fixed by this Court.

2. Heard the learned counsel appearing on either side. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself.

3. It is the case of the petitioner that his original date of birth is

20.08.1997 which is evident through his Birth Certificate however, his date of birth has been inadvertently mentioned as 20.07.1997 in the above mentioned X Standard Mark Sheets dated 31.05.2013, 19.11.2021 & 26.06.2022 and also in the Transfer Certificate issued by the fourth respondent School and hence, he made representations to the respondents on 05.02.2024 and 24.12.2025 respectively, however there was inaction on the part of the respondents and hence, the present Writ Petition.

4. The learned counsel for the petitioner drew the attention of this Court to the order passed by this Court in W.P.No.250 of 2022 dated 10.01.2022 [Jayaprakash Vs. 1. The Secretary, Department of School Education, Secretariat, Chennai-9 and 4 others] and prayed that the same benefits shall be extended to the petitioner herein. The relevant portions of the said order reads as under:

“10.Perusal of the decisions cited supra makes it clear that Subsidiary Rule 5 of the Secondary School Leaving Certificate scheme, relied on by the respondents to contend that the application for alteration in the date of birth will not be entertained after a pupil had completed his course or appeared for the S.S.L.C public examination also is much earlier to the advent of the Registration of Births and Deaths Act,1969 and the rules framed thereunder. Needless to say that the provisions of any Central Act, will prevail over the State Act or the rules or regulations, framed by the latter, on the same subject.
