The writ petition is filed directing the respondents to issue death certificate to the petitioner's missing father, who is missing for the past 10 years by considering the petitioner’s representation dated 18.12.2025.
2. When the matter came up for hearing, the learned Government Advocate, on instructions, would submit that already the representation has been considered and an order has been passed on 24.12.2025 directing the petitioner to approach the Civil Court.
3. It is also further submitted that a Division Bench of this Court in W.P.(MD) No.18886 of 2024, dated 25.02.2026 in the case of S.Panjavarnam vs. The Tahsildar, Ramanathapuram, had finally taken a view that in such matters of missing cases, the aggrieved persons have to take recourse only before the civil court.
4. In view thereof, this writ petition is disposed of on the following terms:
(a)The petitioner shall approach the competent Civil Court in the manner known to law for due declaration in accordance with law;
(b) As and when such suit is filed, the same shall be decided as expeditiously as possible, in any event not later than six (6)
months from the date of an institution of the suit; and (c) No costs.
