ORDER
Challenging the impugned order passed by the trial Court in I.A.No.2 of
2025 in HMOP.NO.994 of 2024, wherein the learned trial Judge awarded interim maintenance to the minor child, the respondent / father of the child has preferred this revision.
2. On considering the submissions made on both sides, it is seen that the
1st respondent, wife filed the application seeking interim maintenance for herself and the minor child, claiming a sum of Rs.20,000/-, stating that she has no sufficient source of income and that the child, aged about four years, is studying in LKG. It is also seen that the revision petitioner is working as an Assistant under the Government of Tamil Nadu and is earning about Rs.36,307/- per month. After considering the income of both parties, the learned trial Judge awarded a sum of Rs.10,000/- as interim maintenance to the minor child and did not grant any maintenance to the wife.

The trial Court also took note of the fact that the wife is an MBA graduate, working as an Assistant in a Tamil Nadu Government Bank, earning about Rs.40,000/- per month, and residing in her own house. Hence, no maintenance was awarded to her. However, since she is taking care of the minor child, a sum of Rs.10,000/- was awarded towards maintenance for the child.
Aggrieved by the same, the father has preferred the present revision petition.
4. On a perusal of the reasons assigned by the learned trial Judge, it is seen that the Court has properly considered the salary and financial status of both parties and has rightly awarded maintenance only to the child. The order passed by the learned trial Judge does not require interference.
5. However, considering the overall circumstances, this Court directs the revision petitioner to pay a sum of Rs.8,000/- per month to the account of the minor child. The arrears amount shall also be paid from the date of the application till the date of disposal of the petition, without fail, within a period of six weeks, by depositing the same in the bank account of the minor child. The arrears shall be calculated as per the revised amount from the date of the original petition till the disposal of the I.A.
6. If there is any failure on the part of the revision petitioner to comply with the above direction, he shall not be entitled to proceed with the main H.M.O.P.No.994 of 2024 proceedings.
7. In view of the above, this Civil Revision Petition is disposed of.
Consequently, connected miscellaneous petition is closed. No costs.
