Heard Mr.R.Murali, learned counsel for the petitioner and Mr.S.Shaji Bino, learned Special Government Pleader appearing for the respondent.

2. With the consent of both sides, this Writ Petition is disposed of at the admission stage itself.

It is the case of the petitioner that he was placed under suspension through the proceedings bearing reference Roc.No.A1/3977/2025 dated 06.05.2025, as he was involved in a criminal case in Crime No.9 of 2025 under Sections 7(a) and 7(b) of the Prevention of Corruption Act, 1938. However, thereafter, no departmental proceedings have been initiated against the petitioner and no charge has been issued to him as on date.

In the light of the prolonged suspension, the petitioner claims to have submitted a representation dated 02.02.2026 requesting the respondent to review the order of suspension in the light of the orders issued by the Government in G.O.(Ms) No.81, Human Resources Management (N1) Department, dated 04.08.2022. According to the learned counsel for the petitioner, detailed guidelines have been laid down in the said Government Order and therefore, the respondent is under an obligation to review the order of suspension in the light of the guidelines laid down in the aforesaid Government Order.

5. The learned Special Government Pleader appearing for the respondent did not resist the claim made by the petitioner.

6. In the light of the above, this Court does not see any reason to go into the merits of the matter. Accordingly, taking into consideration the fact that the prolonged suspension is also not in the interest of the State and that the same would result in expenditure without extracting any work from the petitioner, this Writ Petition is disposed of, directing the respondent to consider the representation dated 02.02.2026 submitted by the petitioner, duly taking into consideration the orders issued by the Government in G.O.(Ms) No.81, Human Resources Management (N1) Department, dated 04.08.2022 and pass appropriate orders thereon as expeditiously as possible, at any rate within a period of four weeks from the date of receipt of a copy of this order. No costs.
