ORDER

This Writ Petition is filed to issue a Writ of Certiorarified Mandamus, to call for the records connected with the Impugned Order passed by the Respondent No.3 in Na.Ka.No. 06/Ka.Aaivalar/ ka.Kaa.Ni./ Pudukkottai/ 2026 dated 24.02.2026 and quash the same as illegal, consequently direct the Respondents no.3 to grant permission and adequate police protection to conduct demonstration on 12.03.2026 at 05.00 pm near Gandarvakkottai bus stand, Pudukkottai District or any other alternative date and place by considering petitioners representation dated 28.02.2026 in accordance with law within the time stipulated by this Court.

Learned counsel for the petitioner submitted that seeking to quash the impugned order of the third respondent in Na.Ka.No. 06/Ka.Aaivalar/ ka.Kaa.Ni./ Pudukkottai/ 2026 dated 24.02.2026, declining the petitioner to organize a protest, against the attack on the SC/ST community people and one person namely N.Stalin.

The learned counsel for the petitioner further submitted that the third respondent police had registered a first information report in Crime No.42 of 2026 on receiving a complaint from one N.Stalin, only as against 4 persons. To include the name of one Karthi in the FIR as an accused and for having registered such a case, the petitioner, being the Secretary of Puthiya Samathuva Katchi, had made an application before the third respondent, seeking permission for conducting appropriate protest, which was declined by the impugned order. Challenge the same this writ petition is filed.

4. The learned Government Advocate, categorically contended that the question of conducting a protest by a third party for an unrelated issue, is unwarranted. In this regard, already a compromise has been entered into between the said Karthi said Stalin and others, and they have also executed compromise deed. While so, the petitioner is trying to open up a can of worms by unnecessarily inciting caste feeling in the name of protest and hence, the impugned order came to be passed. There is no infirmity in the impugned order and sought for dismissal of the Writ Petition.

5. Heard both sides and carefully perused the materials available on record.

6. On perusal of the deed of compromise entered into between the rival parties in Crime No.42 of 2026 on the file of the third respondent police, I do not find any merits in the petitioner's submission to inter interfere with the impugned order.

7. Accordingly,this Writ Petition is dismissed. No costs.
