It is the case of the petitioners that, pursuant to the tender notification dated 12.01.2026, they submitted their bids. The technical bids were accepted on 31.01.2026, and the financial bids were opened on 25.02.2026, which is evident from the tender summary report annexed in the typed set of papers. The further case of the petitioners is that, without cancelling the earlier tender process, the respondents have issued a fresh tender notification dated 12.01.2026, which was published on
19.02.2026, for the very same work.
2.The learned Government Advocate appearing for the respondents has not placed any material on record to show that the financial bids submitted by the petitioners were rejected or that the earlier tender notification dated 12.01.2026 was withdrawn. In such circumstances, the issuance of a fresh tender notification without cancelling the earlier tender notification is impermissible and legally unsustainable.
3.Accordingly, this Writ Petition is allowed and the impugned tender notification dated 12.01.2026, published on 19.02.2026, issued by the sixth respondent, is hereby quashed. The respondents are directed to pass appropriate orders on the financial bids submitted by the petitioners pursuant to the tender notification dated 12.01.2026, or pass appropriate orders to proceed with the tender process or cancel the tender strictly in accordance with law. No costs. Consequently, the connected miscellaneous petitions are closed.
