JUDGMENT

2. The review applicant joined the police department as Police Constable on 25.101984. He was promoted as Police Constable Grade I on 25.07.1995. He became a Head Constable on 25.07.2000. He sought promotion to the post of SSI. According to the petitioner, he was promoted belatedly only in the year 2010. The case of the writ petitioner is that he should have been given promotion much earlier. He relied on the order dated 13.04.2006 made in W.P.Nos.344, 347 & 391 of 2006. Seeking the aforesaid relief, the petitioner filed W.P.(MD)No.1936 of 2014. The said writ petition was posted before the Hon'ble Division Bench along with a batch of writ petitions in which some other legal issue was raised. The Hon'ble Division Bench was called upon to consider whether on the expiry of 25 years of service, a person who joined as Police Constable Grade II can automatically be promoted as SSI. While answering the issue in the negative and dismissing the writ petitions, the writ petition filed by the review applicant also suffered dismissal.

3. In fact, the review applicant's case was that he should be given parity of treatment along with his batchmates. The issue raised by the writ petitioner was not similar to the issue raised by the other writ petitioners. We therefore set aside the order dated 23.10.2019 dismissing W.P.(MD)No.1936 of 2014. This Review Application is allowed. Registry to list W.P.(MD)No.1936 of 2014 before the Hon'ble Single Judge holding roster. Consequently, connected miscellaneous petitions are closed.
