ORDER

This petition has been filed challenging the order of the 3rd Respondent in Ref. No.Ma.A.10/Po.Su.Thu/Na.Ka.No.SPL./2025 dated 16.09.2025 and quash the same and consequently direct the 3rd Respondent to make appropriate correction by replacing my second husbands name Mr.R. Dhanraj instead of first husbands name Shenpagamoorthy in the birth certificate of petitioner son S.B. Rudrav Bearing Reg. No.2018/10/129/000024/0 dated 22.10.2021 issued by the Public Health Department, Greater Chennai Corporation on the basis of petitioner representation dated on 28.8.2025.

2. It is the case of the petitioner that that she was initially married to one Shenbagamoorthy, however, her marriage was not consummated and she was started living separately from 2016 onwards. Later, she developed relationship with R.Dhanraj and on 10.01.2018, she gave birth to male child and the birth was registered, wherein, her first husband name is entered as father. Later the first marriage was dissolved by way of mutual consent decree dated 05.12.2024 and thereafter, she married R.Dhanraj on 11.04.2025 at Periyar Thidal, Chennai and was registered on the of SRO, Periamet. Hence, she made a representation seeking correction in child's birth certificate, however, vide the impugned order the same was rejected. Hence, this petition.

3. Heard both sides and perused the materials placed on record. At the outset, this Court is at loss at understand as to how this writ petition is maintainable. The case involves purely disputed question of fact which can be ventilated only before a competent civil court and this Court cannot conduct roving enquiry in deciding the disputed question of facts. Therefore, this Court does not find any merits in this writ petition. Liberty is granted to the petitioner to work out the remedy in the manner known to law.

4. Accordingly, this writ petition stands dismissed. No costs.
