O R D E R
1. The petitioner is before this Court seeking issuance of a Writ of Mandamus directing the first respondent to direct the second respondent to pay the entire amount due towards completion of civil works entrusted to the petitioner by the second respondent with interest.
2. The petitioner contended that when the Special Officer was appointed to the second respondent from 25.10.2016 to 18.02.2022, the petitioner was entrusted with execution of civil work and the petitioner claims to have executed the civil work to the satisfaction of the second respondent. Despite completion of the civil work, the second respondent has not taken any steps to pay the amount due and therefore, he submitted a representation, dated 06.03.20224.
3. The learned Counsel for the second respondent submitted that the elected Council assumes charge on 02.03.2022. However, a No Confident Motion was moved against the Chairman of the second respondent, against which, he has obtained an stay and therefore, the representation of the petitioner has not been considered. He further submitted that the representation submitted by the petitioner will be considered, if reasonable time is granted, so as enable the second respondent to place the proposal before the Elected Council for approval.
4. The said submission is placed on record. The Writ Petition is disposed of directing the second respondent to place the proposal for payment of admissible amount due to the petitioner for having completed the civil Court before the Elected Council within a period of three months from today and upon approval, the second respondent shall pay the admissible due to the petitioner within a period of one month thereafter. No costs.
