This Writ Petition has been filed seeking a direction to the respondents 1 and 2 to distribute compensation for the respective farmers as per the available list (Form-1A) with the 2nd respondent, as it is mentioned in his proceedings in Na.Ka.Pe Mae 24(1)/2018 dated

31.07.19 within a time frame fixed by this Court as per the representation made by this petitioner dated 14.10.2019.

The main grievance of the petitioner claiming to be a member of the association that the State Government has not distributed any relief for all other species of trees like Jack Fruit Tree, Plantain Tree, Casuarinas, Sandal Wood Tree, Teak and Lemon Tree, except the Coconut tree, which were affected by Gaja Cyclone. In this regard, the petitioner has also submitted a representation on 19.07.2019 before the 2nd respondent. However, the same has not been considered by the 2nd respondent. Hence, the petitioner has filed this Writ Petition.

The learned Additional Government Pleader appearing for the respondents by referring to the counter affidavit filed by the 2nd respondent submitted that the entire compensation amount were distributed to the farmers and residents, who were affected by Gaja Cyclone. Paragraph No.7 of the counter affidavit reads as follows:

“7. I respectfully submit that, In G.O.(Ms). No.380 dated 27.10.2015, in the revised list of items and norms of assistance from State Disaster Response Fund (SDRF) and National Disaster Response Fund (NDRF) were notified as follows:-

As per the above guidelines, a proper inquiry and field visit were carried out by the Tahsildars, agriculture and Horticulture officers in the affected areas to evaluate the damages and devastations caused by the Gaja Cyclone on an individual basis. Subsequently, the relief fund and compensation packages were distributed to the affected farmers based on the above guidelines as per G.O. Hence I deny the petitioner's averments, which contain no proper knowledge of facts

8. I humbly submit that the G.O. (Ms). No.458 dated 20.11.2018 categorically stipulates that, "para 3. Based on the announcement of the Hon'ble Chief Minister in the Press Statement dated 19.11.2018 and the proposal of the Additional Chief Secretary/Commissioner of Revenue Administration, the Government accord sanction for a sum of Rs. 1000.00 crore (Rupees Thousand crore only) from State Disaster Response Fund (SDRF) to the District Collectors and Line Departments for carrying out the relief and restoration measures in the affected Districts as detailed below:-
