4th to take immediate and necessary steps to demarcate, subdivide, lay survey stones by ear-marking the lands in respect of the public pathway being used as Cart-Track passing through survey Nos.101, 112 and 113 by removing the illegally erected iron fencing put up by the respondent Nos.5 to 7 which is leading to the petitioner's land situates survey Nos. 134/2, 134/3, 134/4 135/2 135/3 135/4 and 133/7 and for a consequential direction to effect mutation in the connected revenue records thereon to reflect the name of the Government as Cart-Track in the light of the memorandum in Mu.Mu.No.A2/2724/2025 of the fourth respondent dated 02.06.2025 which was ascertained by the Village Administrative Officer of Surangudi by his certificate dated 10.11.2025.

The petitioner has filed this writ petition directing the respondent Nos.1st to 4th to remove the encroachment made by the respondent Nos.5 to 7 in Government Cart-Track.
2.Mr.A.Kannan, learned Additional Government Pleader, accepts notice for the respondents 1 to 4. In view of the order proposed to be passed in this writ petition, notice to the respondents 5 to 7 is dispensed with.
3.By consent of both parties, this writ petition is taken up for final disposal at the time of admission itself.
4.It is the contention of the petitioner that the respondents 5 to
7 have encroached upon the cart track. Though the petitioner submitted a representation in this regard, the same did not evoke any response.
Hence, the petitioner has filed the present writ petition.
5.The learned Additional Government Pleader appearing for the respondents 1 to 4 submitted that the petitioner's representation was considered and field inspection was conducted. It is found that the private respondents have encroached upon the cart track and hence, notice has been issued to them under the provisions of the Land Encroachment Act. He further submitted that appropriate action would be taken to remove the encroachment.
6.In such view of the matter, the authorities concerned are directed to conclude the proceedings initiated under the provisions of the Land Encroachment Act, after issuing notice as well as opportunity of personal hearing to the petitioner, the private respondents and all other parties concerned, if any, and by following due process of law, within a period of three months from the date of receipt of a copy of this order.
7.With the above direction, this writ petition is disposed of.
There shall be no order as to costs.
