ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.)

The petitioner has filed this writ petition seeking a direction to the respondents 1 to 4 not to erect the Airtel Cell Phone Tower on the land of 6th respondent, situated in Old Survey No.382/1A2A1, Town Survey No.13, Plot No.16, situated at Gopalipuram, Madakulam Village, Madurai District, by considering the representations dated 21.07.2025 and 02.03.2025.

2.Mr.A.Kannan, learned Additional Government Pleader, accepts notice for the respondents 1 to 4 and Mr.M.Ponniah, learned counsel, accepts notice for the fifth respondent. In view of the order proposed to be passed in this writ petition, notice to the sixth respondent is dispensed with.

3.By consent of both parties, this writ petition is taken up for final disposal at the time of admission itself.

4. According to the petitioner, a cell phone tower is proposed to be installed in the subject property, which is situated in a residential area. He would submit that radiation emitted by the tower will cause health hazards to the public living in that locality. Hence, he seeks a direction not to erect tower in the subject property.

5.At the outset, merely on the basis of the apprehension without any scientific study, as a matter of right, such a blanket direction as sought for by the petitioner cannot be granted. Hence, we are not inclined to entertain this writ petition.

6.Accordingly, this writ petition is dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
