Prayer: This writ petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the Respondents to return the original title deeds deposited by the petitioner with M/s.Vysya Bank Limited, Salem Branch, which has been amalgamated with the Respondent, for the loans granted to the petitioner and which have been fully discharged by the Petitioner.

ORDER

This writ petition is filed to return the original title deeds deposited by the petitioner with the respondent bank for the loans granted to the petitioner. 2. Learned counsel for the petitioner would submit that the petitioner has borrowed loans from the respondent/bank by depositing the original titles and the said loans have been settled by virtue of the order of this Court dated 30.06.2020. However, the respondent retained the original documents for the case T.A.No.208 of 2008, pending before the Debts Recovery Tribunal, Madurai, which was later dismissed on 10.05.2018. Since the petitioner has settled the entire loan amount and there was no case was pending against him, he is entitled for original documents, which were produced to secure the loans. But, till date, the original documents were not returned to the petitioner. Hence, this writ petition.

3. Learned counsel for the respondent is not in a position to dispute the submission made by the learned counsel for the petitioner.

4. Heard the learned counsel on either side and perused the materials available on record.

5. Such being the case, this Court directs the respondent to return all the original title deeds deposited by the petitioner with M/s.Vysya Bank Limited, Salem, which has been amalgamated with the respondent, for the loans granted to the petitioner, within a period of two weeks from the date of receipt of a copy of this order.

With the aforesaid direction, this writ petition is disposed of. No costs.
