ORDER
The writ petition has been filed to quash the proceedings of the first respondent dated 02.08.2024 and to direct the respondents to reinstate the petitioner into service and to grant him all consequential service and monetary benefits.
2. The grievance of the petitioner is that he had been placed under suspension, by the impugned order of the first respondent dated 02.08.2023, based on the Special Bye Law 31 of the Society and under Tamil Nadu Co- operative Societies Act, 1983, alleging that the petitioner had transferred an amount to the tune of Rs.10,39,672/- to individuals for the period 01.04.2023 to
31.03.2024.
3. The petitioner would submit that he had entered the Society as a Clerk and has now been elevated to the post of Secretary . The contention of the petitioner is that the alleged amount that has been paid to two individuals namely Tmt.Subbulakshmi and Tmt.Vasantha, represents the value of the milk supplied by them. They are members supplying milk to the Society for a long time, and it is not a case of misappropriation. Therefore, the petitioner is before this Court to quash the impugned proceedings and to reinstate him into service and grant him all consequential service and monetary benefits.
4. The learned counsel appearing for the petitioner would submit that the petitioner has also filed an appeal before the Deputy Registrar, Milk Production, Thiruvannamalai, to consider the petitioner's representation to review his suspension.
5. Heard the learned counsel on either side and also perused the materials placed before this Court.
6. Though the relief claimed by the petitioner in the present writ petition is to quash the proceedings of the first respondent dated 02.08.2024, to direct the respondents to reinstate him into service and to grant him all consequential service and monetary benefits, it is seen that the petitioner has already filed a revision before the 3rd respondent under Section 153 of the Co-operative Societies Act on 13.11.2024, and the same is yet to be disposed of, this Court directs the 3rd respondent to dispose of the revision filed by the petitioner, within a period of one month from today.
7. With the above directions, the writ petition is disposed of. No costs.
Consequently, connected miscellaneous petitions are closed.
