This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondent to consider and dispose off the A.P.No.12 of 2025 and pass orders within a time frame to be stipulated by this Honble Court and pass.

ORDER

This petition has been filed seeking a direction to the respondent to consider and dispose off the A.P.No.12 of 2025 and pass orders within a time frame to be stipulated by this Honble Court.

2. It is the case of the petitioner that the petitioner is the Natanmaikarar of the Village and has been appointed as Non-hereditary Trustee of the Temple viz., Vinayagar Mariyamman, Muthalamman & Bhagavathi Amman Temple, Tharagampatti Village. In such circumstances, the poosaries of the temple had filed OA.No.10 of 2024 under Section 63(b) of the Act seeking declaration that the office of the Temple is Hereditary before the joint Commissioner, HR & CE Tiruppur, the poosaries and the ancestors were never in administration of the temple or contributed or donated towards its construction, administration and functioning at any point of time are only the servants of the temple and were involved only in the performance of daily poojas and the same was ordered in favour of them. Challenging the same, the petitioner had filed AP.No.12 of 2025 before the respondent and the same is pending for more than a year.

Hence, the petitioner filed the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondent to consider and pass orders on the petitioners appeal within the stipulated time as fixed by this Court.

4. The learned Government Advocate appearing for the respondent submitted that the appeal will be heard and orders will be passed within the stipulated time as fixed by this Court.

5. Heard the learned counsel for both sides and perused the materials available on record.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the respondent to consider and pass orders on the appeal in AP.No.12 of 2025 on the file of the respondent which was initiated by the petitioner within a period of twelve weeks from the date of receipt of a copy of this order.

7. With the above directions, the writ petition is disposed of. No costs.
