This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, to direct the 1st respondent to complete the enquiry initiated under Sec. 36(1) of the Tamil Nadu Societies Registration act 1975 within a time frame fixed by this Honourable Court and send the report / recommendation to the government for appointment of Special Officer to administer the society if necessary.

ORDER

This petition has been filed seeking a direction to the 1st respondent to complete the enquiry initiated under Sec. 36(1) of the Tamil Nadu Societies Registration act 1975 within a time frame fixed by this Honourable Court and send the report / recommendation to the government for appointment of Special Officer to administer the society if necessary.

2. It is the case of the petitioner that the second respondent was elected as the General Secretary on 11.11.2018 and has been holding the post since then. There had been widespread mismanagement, maladministration, corruption and misappropriation of society funds by the General Secretary and other administrators, The secretary has borrowed a sum of Rs.5,00,000/- on behalf of the Society and had allowed the attachment of property worth around 1.9 crores and the same was also sold in the auction for a sum of Rs.14 lakhs due to collusion between the creditor and the second respondent, despite the resolution passed by the members of the society to bid for the property in the auction and many such mismanagement and misappropriation. A representation dated 05.05.2025 and 31.07.2025 to the first respondent for initiating enquiry under Section 36(1) of the Tamil Nadu Societies Registration Act, 1975. Based on the representation, the first respondent has also initiated enquiry under the above said Act and the same is pending. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to conclude the enquiry which was initiated under Section 36(1) of the Act by the first respondent within the stipulated time as fixed by this Court.

4. The learned Government Advocate appearing for the first respondent submitted that the enquiry will be concluded and appropriate orders will be passed within the stipulated time as fixed by this Court.

5. Heard the learned counsel for both side and perused the materials available on record. Since no adverse order is passed against the second respondent, notice to the second respondent is dispensed with.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the first respondent to conclude and pass orders on the enquiry which was initiated against the petitioner under Section 36(1) of the Tamil Nadu Societies Registration Act, 1975 within a period of twelve weeks from the date of receipt of a copy of this order.

7. With the above directions, the writ petition is disposed of. No costs.
