ORDER

This writ petition is filed for a mandamus to consider the petitioner's representation dated 24.01.2026.

2.Upon hearing the learned counsel for the petitioner and perusing the material records of the case, the prayer in the writ petition is to conduct an audit by the State Government in respect of the Waqf Board viz., Hazrath Khaja Syed Sultan Alaudeen Aulia Dargah and Mosque, Goripalayam, Madurai, for the period from 2018 till date within time fixed by this Court.

3.The learned counsel appearing on behalf of the Waqf Board submitted that when the petitioner approached this Court, this Court directed the Senior Accounts Officer of the Tamil Nadu Waqf Board to conduct audit and submit his report. Accordingly, the Senior Accounts Officer is on the job and his report is yet to be submitted to the Waqf Board. In view thereof, when the task is in progress, in between one more prayer to direct the respondent to conduct an audit cannot be countenanced.

4.Let the Senior Accounts Officer complete the job and submit the report to the Waqf board. Let a copy of the said report also be furnished to the petitioner. If the petitioner is aggrieved of the same, the petitioner the petitioner can also make representation to the waqf board. It is for the waqf board to consider the same and pass orders in accordance with law.

5.In view thereof, this writ petition is disposed of on the following terms:

(i)The prayer of the writ petitioner to direct the State Government Audit Department to conduct an audit shall stand rejected for now.

(ii)Let the Senior Accounts Officer of the Tamil Nadu Waqf Board shall complete the auditing process and submit a report to the Waqf board as expeditiously as possible, in any event not later than 12 weeks from the date of receipt of the web copy of the order.

(iii)As and when such report is filed, a copy thereof shall also be furnished to the petitioner within a period of two weeks from the receipt of the report.

(iv)The petitioner is aggrieved thereof or the petitioner wants any further action based on the report, the petitioner shall make a representation within two weeks there from which shall be considered in accordance with law by the sixth respondent board and orders be passed in accordance with law. No cost.
