Prayer:-Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus to consider petitioner representation dated 22.11.2025 by the 3rd and 4th respondents and direct them to assign duty as prescribed under the Tamil Nadu Home Guards Rules, 1963.

ORDER
This Writ Petition has been filed for the following reliefs:-
“To consider petitioner representation dated 22.11.2025 by the 3rd and
4th respondents and direct them to assign duty as prescribed under the Tamil Nadu Home Guards Rules, 1963.”
2. The case of the petitioner is that he is the senior-most Home Guard in the Western Zone of the Tamil Nadu Home Guards, Chennai, serving as a Company Commander under T-4 Maduravoyal Police Station. In his capacity as Company Commander, his duties include assisting the Divisional Commander and submitting reports regarding the functioning of platoons and other Home Guard members, in accordance with the provisions of the Tamil Nadu Home Guards Rules, 1963.
3. At an earlier point in time, the petitioner was removed from service on untenable and flimsy grounds. His appeal against the said removal was not considered, compelling him to file W.P. No. 14294 of 2020 before this Court. This Court was pleased to allow the said writ petition, pursuant to which the petitioner’s appeal was considered, and he was reinstated into service.

While so, instead of assigning duties in accordance with established norms, a junior Home Guard, namely Mr. Muneeshwaran, has been entrusted with the responsibility of submitting reports, which rightly falls within the domain of the petitioner as Company Commander. The petitioner brought this irregularity and dereliction of duty to the notice of his superior officers, however, no action or corrective measures were taken.

The petitioner would further submit that the said assignment of duties to Mr.Muneeshwaran is arbitrary and motivated, as he is being utilized as an orderly for rendering personal services to senior Home Guard officials, including driving their vehicles, rather than being assigned official responsibilities in accordance with the Rules. Aggrieved by the inaction of the authorities, the petitioner submitted a representation dated 22.11.2025 to the concerned senior officials, seeking appropriate action. However, the said representation has not been considered to date.
Hence, the present Writ Petition.
6. Today, a Status Report has been filed by the Deputy Commissioner of Police (Admin) Greater Chennai Police wherein in paragraph no.5 it has been stated as follows:-
“5. It is further submitted that moreover, there is no rule prescribed in the Tamil Nadu Home Guard Rules, 1963 mentioning whether Junior or Senior Company Commander in the hierarchy must give report to the Divisional Commander Rank in the Monthly Parade and hence, the Petitioner was given the chance to report in the January-2026 Monthly Parade of West Zone based on his representation made on 22.11.2025.”
7. Recording the same, the Writ Petition is disposed of. No costs.
