Versus
Th Director of Drugs contrl – Respondent
WP No. 8118 of 2026
For the Appellants/Petitioners: G.S. Prabu
For the Respondents: K. Tippu Sulthan
The court directed the respondents to consider and pass appropriate orders on a representation for de-sealing business premises in accordance with the law, after providing an opportunity for a hearing to the petitioner.
Headnote:The petitioner filed a petition under Article 226 of the Constitution of India seeking a Writ of Mandamus to direct the respondents to remove the seal from business premises and allow operation under valid drug licenses. The petitioner, a pharmaceutical dealer, had premises sealed and was arrested for alleged offenses under Sections 8(c) r/w 22(b) of the NDPS Act, 1985, and Sections 18(c) and 27A(1) of the Drugs & Cosmetics Act, 1940. Following release on conditional bail, a representation dated 30.12.2025 for de-sealing the premises was submitted but remained unconsidered. The primary issue was whether the respondents should be directed to consider the petitioner's representation for the restoration of business activities. The court observed that the petitioner sought limited relief, specifically a direction to the respondents to consider the pending representation and pass appropriate orders. This Writ Petition stands disposed of with the aforesaid direction.
