IN THE HIGH COURT OF JUDICATURE AT MADRAS
M. Dhandapani, J
A.SHAVERI BEGUM – Appellant
Versus
The Secretary/Chief Executive officer – Respondent
WP No. 7938 of 2026

Advocates:
For the Appellants/Petitioners: D. Muthukumarappa
For the Respondents: Fakkir Mohideen

The court directed the respondent authority to consider and decide upon a representation for the appointment of Muthavallis to an endowment within a stipulated timeframe, ensuring a fair hearing for the parties involved.

Headnote:The petition was filed under Article 226 of the Constitution of India seeking a Writ of Mandamus. The petitioners, being descendants of the founder of an endowment, submitted a representation dated 20.08.2025 requesting appointment as Muthavallis after the previous administrators were removed for mismanagement and irregularities as published in the Government Gazette. The court noted that the representation had not yet been considered. The primary issue was whether the respondent should be directed to consider the petitioners' representation for appointment. The court observed that since the relief sought was limited to the consideration of the representation, the respondent should be directed to pass appropriate orders in accordance with the law after providing a hearing to the interested parties. This Writ Petition stands disposed of with the aforesaid direction.

ORDER

The present Writ Petition has been filed seeking a direction to the respondent to consider the petitioner’s representation dated 20.08.2025 within a time frame to be fixed by this Court.

2. Mr.Fakkir Mohideen, learned Standing Counsel takes notice on behalf of the respondent.

3. It is the case of the petitioners that, the Muthavallis who were administering the M.A.Namazie endowment were removed from the their positions after due enquiry, due to their mismanagement and irregularities in the administration which was published in the Tamil Nadu Government Gazette on 20.05.2025. Subsequently, the respondent had appointed an executive officer to administer the M.A Namazie Endowment. As there is no Muthavalli, as on date, for the Endowment so as to manage its affairs, the petitioners being the descendants of the founder of the Endowment, had submitted a representation dated 20.08.2025 to the respondent seeking to appoint them as Muthavallis to the endowment. However, till date, the said representation has not been considered. Hence, the present Writ Petition.

4. Learned counsel appearing for the petitioners submitted that, it would suffice, if this Court issues a direction to the respondent to consider the petitioners' representation dated 20.08.2025 and pass appropriate orders on the same within the time that may be stipulated by this Court.

5. On the above contention, this Court heard the learned Standing Counsel appearing for the respondent.

6. In view of the limited relief sought for in this Writ Petition, this Court without expressing any opinion on the merits of the case, directs the respondent to consider the petitioners’ representation dated 20.08.2025 and pass appropriate orders on the same in accordance with law within a period of six (6) weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner and any other interested parties.

7. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs.
