PRAYER;
This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the Respondents, particularly the 3rd Respondent to consider petitioner representation dated 21.01.2026 sent for effecting transfer from the existing school to any Panchayat Union Elementary Schools at Thiruchendur Taluk, Tuticorin District.
ORDER
This petition has been filed seeking a direction to the Respondents, particularly the 3rd Respondent to consider petitioner representation dated 21.01.2026 sent for effecting transfer from the existing school to any Panchayat Union Elementary Schools at Thiruchendur Taluk, Tuticorin District.
2. It is the case of the petitioner that the petitioner was employed under the respondent from the year 1996 and she has completed 21 years of service. At present, she is working at Chennangkuppam and she is unable to continue her service due to an unforeseen circumstances for two years. Therefore, the petitioner made a representation to the second and third respondents on 21.01.2026 to effect the transfer from the present school to any panchayat Union Elementary Schools at Thiruchendur Taluk, Tuticorin District and the same is not considered. Hence, the present writ petition.
3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.
4. The learned Special Government Pleader appearing for the respondent submitted that every year, counseling will be conducted for transfer for the teachers who employed in the Panchayat Union School and next transfer counselling will be held in the month of June. If the petitioner wants transfer to any other school, she will participate in the counseling. In the middle of the academic year, no transfer can be entertained by the respondents for the welfare of the students.
5. Heard the learned counsel for both side and perused the materials available on record.
6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the petitioner to participate the counseling for transfer, in future.
7. With the above direction, the writ petition is disposed of. No costs.
