Respondent PRAYER :- Civil Revision Petition filed under Article 227 of the Constitution of India to set aside the order dated 14.10.2025 passed by the Family Court, Thanjavur in I.A.No.4 of 2025 in HMOP.No.178 of 2023 and to direct the respondent to pay the maintenance from the date of application which is on 06.02.2024.

Pitchaimuthu ORDER This Civil Revision Petition has been filed to set aside the order dated 14.10.2025 passed by the Family Court, Thanjavur in I.A. No. 4 of 2025 in HMOP No. 178 of 2023 and to direct the respondent to pay maintenance from the date of the application, i.e., 06.02.2024.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The short point that arises before this Court is whether the award of maintenance should be from the date of the application filed by the revision petitioner or from the date of the order passed by the trial Court.

4. It is observed that the trial Court has inadvertently ordered that maintenance be paid from the date of the order instead of from the date of filing the application.

5. The learned counsel appearing for the revision petitioner submitted that despite the order passed by the trial Court, the respondent has not paid a single rupee.

6. The contention that interim maintenance should be paid only from the date of the order is rejected. The trial Court is directed to take appropriate steps, including effecting arrest, if the respondent fails to furnish sufficient reasons for non-payment of maintenance.

7. Accordingly, this Civil Revision Petition is allowed, and the order dated 14.10.2025 passed by the Family Court, Thanjavur in I.A. No. 4 of 2025 in HMOP No. 178 of 2023 is hereby set aside. The respondent is directed to pay the maintenance from the date of application which is on 06.02.2024. No costs.
