Shanmugam and to pay the family pension to the petitioner along with arrears from the date of death of her husband by considering the petitioner’s representation dated 07-11-2025 on merits and in accordance with the Tamil Nadu Pension Rules, 1978 within the time frame fixed by this Court.

ORDER

The present writ petition is filed for a direction to the respondents to sanction the family pension of petitioners deceased husband Mr. K. Shanmugam and to pay the family pension to the petitioner along with arrears from the date of death of her husband by considering the petitioner’s representation dated 07- 11-2025 on merits and in accordance with the Tamil Nadu Pension Rules, 1978 within the time frame fixed by this Court.

2. The case of the petitioner is that the marriage between the petitioner and one K.Shanmugam was solemnized in front of the elders and the villagers. The petitioner’s husband retired from service as Checking Inspector. The petitioner’s husband died leaving behind the petitioner and four other children. The petitioner requested the second respondent to sanction family pension to her but the respondents have denied to sanction the same and orally stated that there is delay in approaching the office and further stated that being the second wife of her husband they are not in a position to sanction family pension to her. Thereafter, the petitioner submitted a representation dated 07.11.2025 to the respondents requesting them to sanction the family pension. However, the respondents are not taking steps to sanction the family pension to the petitioner.

Hence the petitioner has filed the present writ petition.

Though very many grounds have been raised in this Writ Petition, learned counsel for the petitioner submitted that, it would suffice, if this Court issues a direction to the respondents to consider the petitioner's representation dated 07.11.2025 and pass appropriate orders on merits, within a particular time frame to be fixed by this Court.

4. The learned counsel for the respondents submitted that they have no objection for the said order being passed by this Court.

5. Heard the learned counsel on either side and perused the materials available on record.

6. Taking into consideration the factual aspects of the matter, this court, without going into the merits of the case, directs the respondents, to consider the representation of the petitioner dated 07.11.2025, and pass appropriate orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

7. The writ petition stands disposed of with the above directions. There will be no order as to costs. Consequently, connected WMP No.44630 of 2025 is closed.
