ORDER

This writ petition has been filed seeking for a direction to respondents 1 to 3 to cancel the Sale Deed dated 15.07.2015, registered as document No.5494 of 2015, in accordance with the order passed by this Court in Crl RC No.1706 of 2024 dated 25.08.2015.

According to the petitioner, the petitioner seeks for cancellation of the aforesaid Sale Deed on the ground that it is a bogus document as held by this Court in its order dated 25.08.2025 passed in Crl RC No.1706 of 2024. The learned counsel for the petitioner on instructions submitted that the petitioner along with the 4th respondent, are now willing to present the cancellation deed before the Jurisdictional Sub Registrar to cancel the aforesaid Sale deed.

4. This Court is not expressing any opinion on the merits of the cancellation deed to be submitted by the petitioner and the 4th respondent. 5. Since no adverse orders are passed against the respondents 4 and 5, notice to them is dispensed with.

6. In view of the above undertaking, this writ petition is disposed of with a direction to the Jurisdictional Sub Registrar to take a decision as to whether the cancellation deed to be presented by the petitioner and the 4th respondent jointly, can be registered or not. The aforesaid decision shall be taken by the Jurisdictional Sub Registrar, within a period of four weeks from the date of receipt of the presentation of the cancellation deed by the petitioner and the 4th respondent for registration. In case, the Jurisdictional Sub Registrar decides not to register the document, a refusal check slip shall be issued after duly considering the submissions of the petitioner and the 4th respondent, along with the supporting documents, by passing a reasoned order. No costs.
