Mandamus directs authorities to inquire and remove encroachments from public pathways after notice and due process.

Headnote:Under Article 226 of the Constitution of India, the petitioner sought a writ of mandamus to direct authorities to remove encroachments from government poramboke land classified as a public pathway in Survey No.2306/31. Essential facts include the pathway being obstructed by rock stones, flower pots, and steps despite a prior representation for removal. The court noted the government's undertaking to inquire and remove encroachments if found. The primary issue was whether authorities must remove encroachments from public pathways by due process. The court's reasoning emphasized conducting an enquiry after notice and affording opportunities to parties concerned before removal. The writ petition was disposed of with directions to the first respondent to complete the enquiry and removal process within six weeks.
