ORDER
This writ petition has been filed challenging the impugned order dated
06.11.2024 passed by the respondent.
2. The learned counsel for the petitioner would submit that in this case, initially, a representation was made on 21.07.2023 for issuance of patta and the same was rejected vide order dated 02.10.2024 on the ground that the survey number is wrongly mentioned in the representation. Once again, the petitioner filed representations dated 01.10.2024 & 18.10.2024, however, the same were also rejected vide order dated 06.11.2024 on the very same ground.
3. Further, he would submit that the petitioner is not aware of the suitable survey number of the subject land and hence, filed the representations by mentioning old Survey No.89/2. Hence, he requests this Court to direct the respondents to provide the correct survey number, so as to enable the petitioner to file a fresh representation.
4. In reply, the learned counsel for the respondents had confirmed the submissions made by the petitioner and requests this Court to pass appropriate orders.
5. Heard the learned counsel for the petitioner and the respondents and also perused the entire materials available on record.

In the case on hand, the petitioner had filed representations for issuance of patta, however, the same was rejected vide order dated 06.11.2024 & 02.10.2024 on the ground that survey number was wrongly mentioned by the petitioner in the said representations. However, the said rejection orders appear to be non-speaking orders and the respondents had mentioned nothing with regard to the correct/suitable survey number. In such case, it is clear that the rejection orders were passed by the respondents in mechanical manner and the same are liable to be set aside.
7. Accordingly, the rejection orders dated 06.11.2024 & 02.10.2024 are set aside and the matter is remitted back to the respondents. The respondents are directed to consider the petitioner’s representations dated 01.10.2024 and 18.10.2024 and pass a speaking order within a period of 8 weeks from the date of receipt of a copy of this order.
8. Further, the respondents are directed to mention the suitable survey number in the order, to be passed, so as to enable the petitioner to make a fresh application for issuance of patta.
9. With the above directions, this writ petition is disposed of. No cost.
