The present petition has been filed by the accused persons in C.C.No.355 of 2025, on the file of the learned Judicial Magistrate, Aruppukkottai, seeking to quash the proceedings initiated underSection 138ofNegotiable Instruments Act. 2. According to the learned Counsel appearing for the petitioners, the statutory notice was issued on 19.06.2025 and it was served on 20.06.2025. Therefore, 15 days time had expired on 04.07.2025. In such circumstances, a complaint should have been lodged within a period of 30 days, namely on or before 04.08.2025. However, the complaint having been filed on 20.08.2025, is beyond a period of limitation and therefore, he seeks to quash C.C.No.355 of
2025.

The learned Counsel appearing for the respondent submitted that the cheque was issued on 12.06.2025 and it was presented on 16.06.2025 and it was returned with an endorsement that there are no sufficient funds. Therefore, statutory notice was issued on 19.06.2025 and the notice was served on 20.06.2025. He waited for 15 days i.e., upto 04.07.2025. He has got time to file the complaint till 04.08.2025.
